GENERAL TERMS AND CONDITIONS OF SALE

These Terms and Conditions (“Terms”) govern all sales of products and services made through the website ballfit.co (the “Website”), operated by Lucie Castagne (“Seller”, “we”, “us”, or “our”), to both individual consumers and professionals (“Client”, “you”).

By placing an order on the Website, the Client acknowledges having read, understood, and accepted these Terms without restriction or reservation.


ARTICLE 1 – SCOPE OF APPLICATION

These Terms apply to all products and services offered for sale on ballfit.co, including but not limited to online training programs, digital content, and related services (the “Products”).

The selection and purchase of a Product are the sole responsibility of the Client.

All images, visuals, and illustrations displayed on the Website are for informational purposes only and are non-contractual.

The Seller is bound by an obligation of means, not an obligation of results. Any results obtained from the training programs depend solely on the Client’s personal situation, effort, and application, and cannot engage the Seller’s liability.

These Terms prevail over any other conditions, including those applicable through other distribution channels.

The Seller reserves the right to modify these Terms at any time. The version applicable is the one in force on the Website at the date of the Client’s order.

Electronic records stored in the Seller’s systems constitute proof of transactions unless proven otherwise.

The Client confirms having the legal capacity to enter into a contract and acknowledges that access credentials to training programs are strictly personal, non-transferable, and intended for use by one individual only. Any unauthorized sharing or resale may result in legal action and immediate termination of access without refund.


ARTICLE 2 – ORDERS

2.1 Order Process

The Client selects the Product(s) they wish to purchase directly on ballfit.co.

For online training programs:

Programs are presented on the Website

Payment must be made in full or in installments (when available) via secure payment methods

Once payment (or the first installment) is confirmed, access is granted to the training platform

Training programs are accessible 24/7 for an unlimited duration, unless otherwise stated


2.2 Order Cancellation

Once an order has been validated and access to digital content has been granted, the order cannot be canceled.

Due to the digital and immediately accessible nature of the Products, the Client expressly agrees to waive any right of withdrawal once access is provided.

Deposits and installment payments are non-refundable.


ARTICLE 3 – PRICES

Prices displayed on ballfit.co are those in effect at the time of order placement.

All prices are shown in USD and include applicable taxes unless otherwise stated.

Prices are firm during their validity period. The Seller reserves the right to modify prices at any time outside that period.

A receipt or invoice may be issued upon request or provided electronically.


ARTICLE 4 – PAYMENT TERMS

Payment is due immediately upon ordering, either:

In full, or

In multiple installments, if offered for the selected Product

Accepted payment methods include:

Credit or debit card

PayPal

Bank transfer

Cryptocurrency

The Seller reserves the right to suspend or cancel access to Products in the event of non-payment or payment incident.

No additional fees beyond those charged by payment providers will be billed to the Client.

ARTICLE 4.1 – INTERNAL PAYMENT ALLOCATION

For transparency, the payments received for our services are internally distributed among contributors to the creation and delivery of the Service. This internal allocation:

Does not create any contractual relationship between the Client and the contributors.

Important: Clients pay only Lucie Castagne, who remains fully responsible for the Service and any contractual obligations. None of the co-contributors have responsibility for payments or Service delivery to Clients.


ARTICLE 5 – DELIVERY

All digital Products are delivered electronically via access to the online platform after payment confirmation.

For pre-sale or pre-launch Products, delivery occurs within the timeframe communicated at the time of purchase.

The Seller undertakes reasonable efforts to deliver access within the indicated timelines.


ARTICLE 6 – TRANSFER OF OWNERSHIP AND RISK

Ownership of digital Products is transferred upon payment validation and delivery of access credentials.

No physical delivery is involved.


ARTICLE 7 – REFUND POLICY

No-Refund Policy

ALL SALES ARE FINAL. NO REFUNDS ARE POSSIBLE once access to training content has been granted.

A refund request may be considered only if all of the following conditions are met:

Request made within 14 days of purchase

No part of the training has been viewed

No files or documents have been downloaded

Request sent to [email protected]

⚠️ Important:
If even 1% of the content has been accessed or downloaded, all payments made and remaining installments become non-refundable and immediately due.

This policy reflects the nature of instantly accessible digital products.


ARTICLE 8 – LIMITATION OF LIABILITY

The Seller makes no guarantee regarding results or performance achieved through the use of the Products.

The Seller shall not be held liable in the event of:

Improper use or negligence by the Client

Failure to comply with local laws applicable to the Client

Force majeure events

In all cases, liability is strictly limited to correction or replacement of defective digital content, if applicable.


ARTICLE 9 – INTELLECTUAL PROPERTY

All content available on ballfit.co (videos, texts, images, files, training materials, branding) is the exclusive property of the Seller and protected under U.S. and international intellectual property laws.

Any reproduction, distribution, resale, or sharing—direct or indirect—is strictly prohibited.

In case of violation, the Seller reserves the right to:

Immediately terminate access

Remove all training materials

Take legal action

Do so without any refund


ARTICLE 10 – PERSONAL DATA

Personal data is processed in accordance with applicable data protection laws and the Privacy Policy available on ballfit.co.

Data collected is necessary for order processing and service delivery.


ARTICLE 11 – GOVERNING LAW

These Terms and Conditions are governed by and construed in accordance with the laws of the United States, specifically the State of Florida.


ARTICLE 12 – DISPUTES

In the event of a dispute, the parties agree to seek an amicable resolution before initiating legal proceedings.

Failing such resolution, courts located in Miami, Florida, shall have exclusive jurisdiction.


ARTICLE 13 – CLIENT ACCEPTANCE

Placing an order on ballfit.co constitutes full and unconditional acceptance of these Terms and an obligation to pay for the Products ordered.
